The employer's choice on discovering the contract is to ratify it or to repudiate it. The latter situation is common in trade union collective bargaining agreements. The union authorizes one or more people to negotiate and sign an agreement with management. After a minor reaches the age of majority, he can ratify the contract. Once the contract has been ratified, the ex-minor cannot change his mind and avoid the contract. Ratification consists of any words or conduct of the minor which shows an intent to be bound by the contract. A contract can only be disaffirmed while the individual is a minor. After the person reaches maturity, if the contract continues, the former minor is considered to have ratified the contract and is now bound by the contract terms. A person may ratify by signing something, or by continuing to abide by the contract (making payments, for example). Ratification, as used in this subsection, means the act of approving an unauthorized commitment by an official who has the authority to do so. Unauthorized commitment, as used in this subsection, means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government. The Government can ratify an otherwise unauthorized contract commitment through a direct affirmative act or by constructive means. Constructive notice can be established where an official knew or should have known of a matter but allowed it to continue. Contract ratification is necessary when a contract is voidable but the parties determine that they would prefer to execute and perform the contract anyway. For example, if a 16-year-old signed a contract to purchase a car, that contract would be voidable, as contacts can only be signed by individuals 18 years or older.
